These Terms of Use ("Terms") govern your use of Your Burial Plan, a lead-generation website operated by Munka Consulting Group LLC ("Munka," "we," "us," or "our"). By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.
1. Lead-generation service only
Munka operates this website as a marketing and lead-generation service. Munka is not an insurance agency, insurance carrier, broker, or licensed insurance producer. Munka does not offer, sell, underwrite, recommend, bind, approve, or issue insurance policies.
If you request a call, your information will be shared with Steven Easley, a licensed insurance producer with Vig Victorium Insurance Group. Steven Easley is the exclusive insurance-producer recipient of leads submitted through this version of the website.
2. No insurance application or coverage
Using the website or submitting information:
- Is a request for information and contact
- Is not an insurance application
- Does not create an insurance contract
- Does not bind or issue coverage
- Does not establish eligibility or approval
- Does not guarantee a premium, benefit, carrier, waiting period, or policy
- Does not require you to purchase anything
Any insurance discussion, recommendation, quote, application, underwriting decision, policy, premium, or coverage determination occurs separately through the licensed producer and applicable insurance carrier.
3. Eligibility to use the website
You must be at least 18 years old and located in the United States to use the website. The service is not available in jurisdictions where Steven Easley is not licensed or where the service is otherwise prohibited. Current prototype exclusions include New York, Delaware, and Washington, DC. Availability may change.
4. Information you provide
You agree to provide accurate, current information that belongs to you. You may not submit another person's information without authorization or use the website for fraudulent, unlawful, abusive, or misleading purposes.
You understand that inaccurate or incomplete information may prevent a response or affect which options can be discussed.
5. Contact request and communications
When production consent is enabled, the specific consent language displayed at submission will govern calls and text messages related to your request. Do not submit the production form unless you understand and agree to that language.
Consent to marketing communications is not a condition of purchasing goods or services. Message and data rates may apply if text messaging is enabled. Message frequency may vary. Instructions for stopping text messages will be provided when applicable.
The current frontend prototype does not accept submissions because final legal consent language and delivery configuration have not been completed.
6. No professional advice
Website content is provided for general informational and marketing purposes. It is not legal, tax, financial, medical, or insurance advice. You should review policy terms, exclusions, costs, benefits, waiting periods, and carrier information with a licensed producer and the issuing carrier before making a decision.
7. Website availability and accuracy
We may change, suspend, or discontinue any part of the website at any time. We do not promise that the website will always be available, error-free, complete, or current.
Insurance availability, eligibility, benefits, premiums, and waiting periods vary by applicant, state, carrier, product, and underwriting requirements. No statement on the website overrides the terms of an issued insurance policy.
8. Acceptable use
You may not:
- Use the website for unlawful, fraudulent, or abusive activity
- Submit false, stolen, or unauthorized personal information
- Attempt to access systems or data without authorization
- Interfere with website operation or security
- Introduce malicious code or automated abuse
- Scrape, copy, or republish website content except as permitted by law
- Impersonate another person or misrepresent your identity
We may restrict access or investigate suspected misuse.
9. Intellectual property
The website, branding, copy, design, software, and related materials are owned by or licensed to Munka and are protected by applicable intellectual-property laws. You receive a limited, revocable, nonexclusive right to use the website for its intended personal purpose. No ownership rights are transferred to you.
10. Third-party services
The website may use or link to third-party services, including hosting, analytics, communications, identity validation, customer relationship management, advertising, and insurance-related services. Third-party services are governed by their own terms and policies. We are not responsible for third-party services outside our reasonable control.
Steven Easley, Vig Victorium Insurance Group, and any insurance carrier are separate from Munka. Their insurance activities, advice, applications, and policy administration are their responsibility.
11. Disclaimer of warranties
To the fullest extent permitted by law, the website is provided "as is" and "as available." Munka disclaims warranties of merchantability, fitness for a particular purpose, noninfringement, and any warranties arising from course of dealing or usage of trade.
Munka does not warrant that you will qualify for insurance, receive a particular quote, obtain coverage, be contacted within a particular period, or receive any specific result.
Some jurisdictions do not allow certain warranty disclaimers, so parts of this section may not apply to you.
12. Limitation of liability
To the fullest extent permitted by law, Munka and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill arising from or related to the website.
To the fullest extent permitted by law, Munka's total liability for claims arising from the website will not exceed the greater of the amount you paid Munka to use the website or $100.
Some jurisdictions do not allow certain liability limitations, so parts of this section may not apply to you.
13. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Munka and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, and expenses arising from your unlawful misuse of the website, your violation of these Terms, or information you submit without authorization.
14. Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
15. Changes to these terms
We may update these Terms as the website, services, or legal requirements change. Updated Terms will display a new effective date. Your continued use after an update constitutes acceptance to the extent permitted by law.
16. Severability and entire agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms and the Privacy Policy constitute the agreement between you and Munka regarding use of the website, except for any separate consent or agreement presented at submission.
